Terms of Service

Last updated: Version 0.1
Draft — this document is under legal review and is not yet in force.

These Terms of Service ("Terms") govern your use of the hosting, domain, email and related services ("Services") provided by SecureGate Hosting, a brand operated by [LEGAL ENTITY NAME], company number [COMPANY NUMBER], with registered address at [ADDRESS] ("SecureGate", "we", "us"). By creating an account, placing an order or using the Services, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refund & Cancellation Policy.

1. Your account

  • You must provide accurate, complete contact and billing details and keep them up to date. Domain registrations depend on this information being correct.
  • You are responsible for keeping your credentials secure and for all activity under your account. Tell us immediately at [support email] if you suspect unauthorised access.
  • You must be at least 18 years old, or the age of majority where you live, to open an account.

2. Services and orders

  • Each Service is described on its order page. The specification at the time of your order applies for that billing period.
  • An order is accepted when we activate the Service. We may refuse an order, for example when information cannot be verified or the order would breach our policies.
  • Some Services rely on third-party providers (such as domain registries and registrars). Their rules also apply to you where relevant.

3. Billing and payment

  • Services are billed in advance for the billing cycle you choose. Prices are shown in the currency displayed at checkout and include or exclude taxes as stated on the invoice.
  • Invoices are issued [N] days before the due date. Payment is made by [bank transfer / accepted methods]. A Service is renewed only when its invoice has been paid.
  • If an invoice is unpaid after its due date, we may suspend the Service after [N] days and terminate it after [N] days. Data of terminated Services may be permanently deleted.
  • Domain names are not renewed automatically unless you have paid the renewal invoice. Expired domains follow the registry's grace and redemption rules, which may involve extra fees.

4. Acceptable use

You must use the Services in line with our Acceptable Use Policy and applicable law. We may suspend Services that put our network, other customers or third parties at risk, without prior notice where the risk is urgent.

5. Your content and data

  • You keep all rights to the content you store with us. You grant us only the rights needed to host, back up and deliver it.
  • You are responsible for your own content, and for keeping your own backups. Any backups we make are provided on a best-effort basis unless your plan explicitly includes a backup guarantee.
  • We process personal data as described in our Privacy Policy.

6. Availability and support

  • We aim to keep the Services available and to perform planned maintenance with advance notice where reasonably possible. [Uptime commitment, if any — to be decided.]
  • Support is provided through the client portal's ticket system. Response times depend on your plan and the priority of the issue.

7. Liability

  • The Services are provided "as is" to the extent permitted by law.
  • To the extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected Service in the [three] months before the event giving rise to the claim. We are not liable for indirect losses, lost profits or lost data.
  • Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Termination

You can cancel a Service at any time from the client portal, as described in our Refund & Cancellation Policy. We may terminate Services for serious or repeated breaches of these Terms or for non-payment.

9. Changes to these Terms

We may update these Terms. Material changes will be announced by email or in the client portal at least [30] days before they take effect. The version and date at the top of this page show which version is in force.

10. Governing law and disputes

These Terms are governed by the laws of [JURISDICTION]. Any dispute will be submitted to the competent courts of [CITY], without prejudice to any mandatory consumer protection rights you may have where you live.
